THE Kanyama Local Court was sent into laughter when a woman said her husband has the habit of speaking with his lover in her presence until the battery in his phone goes low after which he switches to her phone to continue the conversation.
This was heard before Justice Ngandwe Mukuka in a case in which Zaina Munga, 30, of Ndola dragged her husband Mabvuto Munga, 30, of chawama to court for divorce.
In passing judgment, Justice Mukuka ordered Munga to pay Zaina KR4,000 as compensation.
Zaina told the court that problems in their marriage started in 2010 when she fell pregnant but had an operation which later developed pus.
She said this resulted in her having to undergo another operation where her womb was removed after which Munga became promiscuous.
Zaina said when they would go to bed; her husband would even go to the extent of openly speaking on phone with his girlfriends in her presence.
“I later heard he impregnated one of his lovers called Rebecca but I forgave him because he promised he wouldn’t have anything to do with her anymore,” she said.
But to her surprise, he continued wantonly communicating with his lover on phone until his battery would go low after which he would switch to Zaina’s phone and continue his conversations, she lamented.
She said when they would quarrel about his behaviour, again in Zaina’s presence; he would phone his lover and ask her to tell him something soothing to make him sleep.
Zaina said one day, Munga slept away from home and when she rang him in the early hours to inquire about his whereabouts, he told her he was sloshed and was at a guesthouse but didn’t know how he got there.
And when he went home the following day, he got some mealie meal, relish and a mattress for their child which he took to his lover.
“To me it appeared my husband had taken her as his second wife so at that point, I told him I was not going to manage to be in a polygamous marriage,” she said.
Zaina said it was clear their marriage was over because whenever they quarreled, he would ask her to sue him for divorce.
She said when push came to shove; he got their fridge, DVD player and moved out of their home resulting in her suing for divorce.
And in his statement, Munga said he loves Zaina so much but what brought about problems in their marriage was her jealous.
He said other than that, Zaina spends too much time on the phone browsing on the internet that she does it even in bed under the blankets.
Munga said because of their marital problems, he asked his friend Jimmy who he knew had wisdom to give him some counsel but in the process, he gave him Castle lager which knocked him out.
“Your honour, I don’t drink, so the four bottles Jimmy gave me got me so drunk that according to him, he couldn’t take me back home but to a guesthouse where I spent the night,” he said.
He admitted that he has a lover with whom he has a child but that he has not married her.
Munga said Zaina has looked after him so well throughout their marriage and that she has been like a mother to him.
He said if the court granted divorce, it would be the worst thing to happen to him.
