Embattled former MMD national secretary, Major Richard Kachingwe has told MMD national chairman Kabinga Pande to ensure that he prepares his office and all related logistics because he will be heading back to his office as chief executive of the former ruling party.
In a letter written for and on behalf of Major Kachingwe by Lungu Simwanza and company, lawyers retained to act for him, it has been contended that the process that led to his expulsion was flawed at law for breach of procedure that needed to be followed in order to initiate disciplinary action by the National Executive Committee.
Kachingwe has further contended since NEC sat as a disciplinary organ, the National Executive Committee is susceptible to the provisions of regulation 9 of the Disciplinary Regulations of 1993 of the MMD which among others provides that a disciplinary organ initiating disciplinary action against an accused member shall serve to the member a written statement setting particulars of the charge made against him and grounds upon which the disciplinary action is based. Major Kachingwe has argued that the NEC did not consider the proper laid down procedure and therefore made a resolution which is purely null and void at law.
Kachingwe has also added that the decision to move the NEC meeting which purportedly expelled him from the party was also irregularly hosted by Dr. Mumba at his residence and that his decision to host the meeting at his Kabulonga home amounted to utter undue influence on the members that sat to ratify the decision made by Mumba.
