A LUSAKA-BASED pastor has been taken to court for allegedly stealing a Samsung mobile phone, garden tools and other items worth over K3,000. This is in a case Daniel Mwale, 68, of Ibex Hil, is charged with robbery.
It is alleged that on September 9, this year in Lusaka, Mwale allegedly stole four picks, an axe, three shovels, a Samsung phone, a brown wallet, assorted clothes and a reflector, altogether valued at K3,500, property of Pathias Chilufya. It is alleged that during the time of the alleged theft, Mwale used or threatened to use violence against Mr Chilufya to get the items he is accused of stealing. He is expected to take plea soon.
Meanwhile, a 35-year-old American has pleaded not guilty to hurling insults and assaulting a Zambian. This is in a matter Ransaan Ahmed Smith, a computer technician of Lusaka’s Olympia, is charged with assault occassioning actual bodily harm.
It is alleged that on October 6, this year in Lusaka, Smith assaulted Augustine Nkole and occasioned him actual bodily harm. When the matter came up for plea before magistrate Nthandose Chabala yesterday, Smith pleaded not guilty to the charge after it was explained to him. At this point, his lawyer Osborne Ngoma applied for bail pending trial. Mr Ngoma explained that his client was of fixed abode and that the offence he is facing is bailable.
He urged the court to take note of the judicial provisions which state that an accused person is innocent until being proven guilty. The State did not object the application for bail. “There being no objection from the State, I grant the application for bail pending trial in the sum of K5,000,” Magistrate Chabala said. She also ordered that Smith provides two working sureties from reputable organisations and residents of Lusaka bound in the sum of K15,000 but in his own recognisance.
Magistrate Chabala further ordered that Smith surrenders his passport to the clerk of court. The matter was adjourned to October 23, for starting of trial. This case is in connection with a video which went viral in which Mr Nkole was being pulled and later stripped naked.
