Man Gets 31 Years For Defiling 16-Yr-Old Imbecile

THE Lusaka High Court has sent to jail a 31-year-old business executive to 15 years imprisonment with hard labour for defiling a 16-year-old imbecile.
The same court has also sentenced a 21-year-old man for a similar offence to 14 years imprisonment with hard labour.
High Court Judge Mubanga Kondolo said it was a pity that some men had now resorted to defiling imbeciles without any remorse or thinking of the consequences that the victims would go through after abusing them.
Joshua Chibuye, a Lusaka business executive of John Laing Township was convicted of one count of defiling an imbecile.
Chibuye defiled the imbecile at her mother’s house in Mtendere where he was conducting his business between October and November
last year.
Facts before the court were that Chibuye defiled the girl on several occasions in the absence of her mother.
On one occasion, Chibuye forced himself on the imbecile in the living room.
The imbecile informed her mother of the ordeal after Chibuye made it a habit to have carnal knowledge of her against her will.
When her mother asked if she could identify him, she agreed, while some neighbours also confirmed finding the accused person in the act with the girl.
She narrated that on November 11, last year, her neighbours managed to apprehend the suspect.
They later took him to the police where he admitted that he knew that the girl was an imbecile but that he decided to be have sex with her because she would not trouble him with financial demands.
In another case, the 21-year-old Wezi Marshal Banda defiled a 10-year-old imbecile after picking her from a special school in Chainama area on January 17 this year.
Banda defiled the girl in an uncompleted house in Woodlands.
Mother of the girl testified that her daughter did not return home on the material day and when she went to her school, she was told that her daughter was last seen with a man who usually sold food stuffs at the school.
And the girl told the court that she was defiled from an uncompleted house where the man threatened to kill her if she told anyone.
